नई दिल्ली: सुप्रीम कोर्ट ने वक्फ संशोधन अधिनियम, 2025 की वैधता को चुनौती देने वाली याचिकाओं पर तीन दिन की सुनवाई के बाद 22 मई 2025 को फैसला सुरक्षित रख लिया है। मुख्य न्यायाधीश बी. आर. गवई और न्यायमूर्ति ऑगस्टीन जॉर्ज मसीह की पीठ ने इस मामले की सुनवाई की।
केंद्र सरकार की ओर से सॉलिसिटर जनरल तुषार मेहता ने कानून का समर्थन करते हुए कहा कि यह मुस्लिम पर्सनल लॉ (शरीयत) अनुप्रयोग अधिनियम, 1937 के अनुरूप है और वक्फ संपत्तियों के प्रबंधन में पारदर्शिता और जवाबदेही सुनिश्चित करता है।
याचिकाकर्ताओं की ओर से वरिष्ठ अधिवक्ता कपिल सिब्बल ने दलील दी कि वक्फ संपत्ति एक बार अल्लाह को समर्पित कर दी जाती है तो उसे वापस नहीं लिया जा सकता, और इस कानून से धार्मिक स्वतंत्रता का उल्लंघन होता है।
केंद्र सरकार ने यह भी बताया कि वक्फ संपत्तियों का पंजीकरण 1923 से अनिवार्य है, लेकिन अब तक इसे नजरअंदाज किया गया है।
सुप्रीम कोर्ट ने स्पष्ट किया कि जब तक कोई मजबूत कानूनी आधार नहीं होता, तब तक अदालतें विधायी मामलों में हस्तक्षेप नहीं करतीं।
अब अदालत के फैसले का इंतजार है, जो वक्फ संपत्तियों के प्रबंधन और मुस्लिम समुदाय के अधिकारों पर महत्वपूर्ण प्रभाव डाल सकता है।
